1 General
These General Terms and Conditions (hereinafter the "GTC") apply to all legal transactions concluded via the online platform www.alpinamed.ch (hereinafter the "Alpinamed Online Shop"). The operator of the Alpinamed Online Shop is Alpinamed AG (hereinafter "Alpinamed").
In the Alpinamed Online Shop, Alpinamed offers, in its own name, a selection of products relating to health, dietary supplements, medical devices and wellness, and sells them directly to customers.
The offer of products in the Alpinamed Online Shop (hereinafter the "Offer") is directed exclusively at customers domiciled or having their registered office in Switzerland.
Deliveries are made exclusively to addresses in Switzerland and to persons over 18 years of age. By submitting an order, customers confirm that they are at least 18 years old.
The Offer is valid for as long as the product can be found via the search function of the Alpinamed Online Shop and/or while stocks last.
Orders for quantities exceeding normal household use may be refused without justification. Alpinamed further reserves the right to set maximum order quantities per product as well as a maximum order value per shopping cart or purchase.
Alpinamed may, at its own discretion, temporarily or permanently exclude from use of the Alpinamed Online Shop any customer who breaches these GTC or makes excessive use of their right of revocation.
2 Product, Price, Shipping Costs, Availability and Delivery Time
2.1 Product and Price
All sale prices published in the Alpinamed Online Shop are stated in Swiss francs and constitute final prices, including all taxes (in particular VAT), any advance recycling fees, packaging costs and any other applicable levies, fees or costs. The only exception is any shipping costs that Alpinamed may charge. Alpinamed reserves the right to change the prices of the products offered at any time. The price decisive for the conclusion of the purchase agreement is the price shown in the Alpinamed Online Shop at the time the order is placed.
2.2 Shipping Costs
Any shipping costs are shown at checkout.
A flat fee of CHF 9.00 (including VAT) is charged for postage and packaging.
For orders with a value of CHF 69.00 (including VAT) or more, delivery is free of charge.
2.3 Availability and Delivery Time
Alpinamed makes every effort to provide current and accurate information on availability in the Alpinamed Online Shop. However, delivery delays may occur at the specialist trading partner, in particular due to production or supply bottlenecks. All information on availability and delivery time is therefore provided without guarantee and may change at any time.
2.4 Product Information
Alpinamed accepts no liability whatsoever for the accuracy and completeness of the respective product descriptions and labelling in the Alpinamed Online Shop.
Images of products in advertisements, brochures, etc. are for illustrative purposes only and are non-binding.
3 Conclusion of Contract
The products and prices shown in the Alpinamed Online Shop constitute an offer. This offer is, however, always subject to the resolutive condition that delivery is not possible or that the price stated is incorrect.
The purchase agreement is concluded directly between Alpinamed and the customer, at the time the order is placed in the Alpinamed Online Shop.
After an online order has been submitted, Alpinamed sends the customer an automatically generated order confirmation to the email address provided. This order confirmation does not constitute any guarantee that the product can actually be delivered. It merely indicates to the customer that the order submitted has been received by the Alpinamed Online Shop and that the contract has therefore been concluded, subject to the condition that delivery is possible and the price stated is correct.
Orders oblige the customer to accept the products. Alpinamed may, at its sole discretion, accept or refuse subsequent changes or cancellations of orders requested by the customer.
If delivery is not possible, Alpinamed may cancel or partially cancel the purchase agreement. The customer will be notified by email. The purchase amount will be refunded, or the customer will be released from the obligation to pay, provided the goods have not yet been paid for. No further claims in favour of the customer arise from a cancellation by Alpinamed.
4 Delivery Date
The customer is shown a delivery time as part of the order process. Once the order has been shipped, the customer receives a shipping confirmation by email. This may contain a tracking link from the shipping provider, which can be used to track the delivery.
If Alpinamed, or the specialist trading partner, is in default of delivery, the customer is entitled, from the 30th calendar day after the originally announced delivery date (except in the case of special orders), to withdraw from the contract. In this case, Alpinamed will refund to the customer any amounts already paid in advance. No further claims exist against Alpinamed or the retailer.
5 Delivery
The ordered products are delivered to the customer by shipment through the specialist trading partner, to the delivery address specified by the customer when placing the order.
The customer's delivery address must be in Switzerland and easily accessible by Swiss Post. If this is not the case, the customer bears any additional costs.
If the customer does not accept the ordered products on the agreed or specified delivery date, Alpinamed may terminate (cancel) the contract and charge the customer for the delivery costs incurred as well as any loss in value.
6 Warranty
6.1 Customer's Duty to Inspect
The customer must inspect delivered products immediately for accuracy, completeness and transport damage.
Transport damage and incorrect or incomplete deliveries must be reported to the specialist trading partner within 5 calendar days of delivery in the case of readily identifiable defects, and immediately upon discovery in the case of defects not immediately identifiable. Such notification must be made via the contact form in the Alpinamed Online Shop or by email. The customer must not put the affected product into use or continue to use it. The delivery is deemed approved if the customer fails to comply with these inspection and notification obligations within the stated period.
6.2 Remedy of Defects
Alpinamed may remedy defects, at its discretion, by way of subsequent performance, either by remedying the defect (repair) or by delivering a defect-free item (replacement delivery). The resulting return costs are borne by the retailer.
6.3 Expiry of Warranty Claims
All warranty claims of the customer expire 24 months after delivery of the products, even if they remained undiscovered until that time.
7 Liability and Exclusion of Liability
Alpinamed's liability is governed by the applicable statutory provisions. However, Alpinamed shall under no circumstances be liable for (i) slight negligence, (ii) indirect and consequential damage and loss of profit, (iii) unrealised savings, (iv) damage resulting from delay in delivery, and (v) any acts or omissions of the retailer's auxiliary persons, whether on a contractual or non-contractual basis.
Furthermore, Alpinamed excludes liability in the following cases:
• improper, contract-breaching or unlawful storage, installation or use of the products;
• force majeure, in particular damage caused by natural events, moisture, falls and impacts, etc., for which the retailer is not responsible, and orders issued by authorities.
8 Payment
The customer is obliged to pay the purchase price. All payments must be made in Swiss francs (CHF).
For this purpose, the customer may use the payment methods offered in the Alpinamed Online Shop under "Payment Options". Alpinamed may unilaterally amend these at any time.
When paying by credit card, TWINT or other instant payment methods, the amount is charged when the product is ordered.
Ordered products remain the property of the retailer until paid for in full. The retailer is entitled to make a corresponding entry in the retention of title register.
Refunds to the customer are made exclusively to the payment method originally used when placing the order.
9 Return of Defect-Free Goods
Alpinamed grants the customer the right to withdraw from the purchase agreement within 14 days of receiving the goods and to return the products received (subject to the exceptions listed below). Only unopened and undamaged products may be returned.
The following products are excluded from the right of return:
• dietary supplements;
• medical devices;
• unsealed health products, such as: nasal sprays, sore throat sprays, nasal douches;
• unsealed cosmetic and body care products, such as: body lotion, body oils, bath products.
The customer must notify Alpinamed of the withdrawal from the contract in writing (via the contact form in the Alpinamed Online Shop, by email or by letter) and will then receive instructions for the return as well as the return address. The costs of returning the goods are borne by the customer.
If the customer exercises the right of return, Alpinamed will refund the full purchase price, less any shipping costs paid.
No returns will be accepted or refunded if they are opened, damaged, excluded from the right of return, or sent to Alpinamed without prior notice of withdrawal. In such cases, the goods concerned will be returned to the customer.
Returns that cannot be attributed to any customer will be disposed of by Alpinamed.
10 Further Provisions
10.1 Data Protection
The processing of personal data by Alpinamed is governed by the Privacy Policy.
10.2 Partial Invalidity
Should individual provisions of these GTC be or become invalid or ineffective, this shall not affect the validity of the remaining provisions or of these GTC as a whole.
10.3 Place of Jurisdiction and Applicable Law
All legal relationships between Alpinamed and the customer are governed by substantive Swiss law.
The place of jurisdiction is the registered office of Alpinamed.
